Objection Filing Procedure

Based on Article 35 and Article 36 of Law Number 14 of 2008 concerning Public Information Disclosure, it states:

Article 35

  1. Every Public Information Applicant may submit a written objection to the superior of the Information and Documentation Management Officer based on the following reasons:

    1. rejection of a request for information based on the reasons for exceptions as referred to in Article 17;

    2. failure to provide periodic information as referred to in Article 9;

    3. non-response to requests for information;

    4. requests for information are not responded to as requested;

    5. failure to comply with requests for information;

    6. unreasonable charges; and/or

    7. delivery of information that exceeds the time stipulated in this Law.

  2. The reasons as intended in paragraph (1) letters b to g can be resolved through deliberation by both parties.

Article 36

  1. Objections must be submitted by the Public Information Applicant within a maximum period of 30 (thirty) working days after the reasons referred to in Article 35 paragraph (1) are discovered.

 

REASONS FOR SUBMITTING OBJECTIONS:

Based on Article 35 of Law No. 14 of 2008 concerning Public Information Disclosure (KIP), the reasons that information applicants can use to file objections are:

 

  • rejection of a request for information based on the reasons for exceptions as referred to in Article 17 of Law No. 14 of 2008 concerning KIP;

  • failure to provide periodic information as referred to in Article 9 of Law No. 14 of 2008 concerning KIP;

  • non-response to requests for information;

  • requests for information are not responded to as requested;

  • failure to fulfill requests for information;

  • unreasonable charging;

  • delivery of information that exceeds the time stipulated in the Law.

PROCEDURES FOR SUBMITTING OBJECTIONS

  Permohonan Informasi Publik mengajukan permintaan Informasi Publik kepada BSPJI Palembang melalui Pejabat Pengelola Informasi dan Dokumentasi (PPID) baik langsung maupun tidak langsung (surat, email, telepon)

If the submission of an objection to Public Information is not satisfied with the decision of the PPID Superior, then the resolution of the Public Information dispute can be submitted to the Public Information Commission.

Atasan PPID BSPJI Palembang memberikan tanggapan atas pengajuan keberatan tersebut paling lambat 30 (tiga puluh ) hari kerja sejak diterima keberatan secara tertulis. Apabila atasan PPID menguatkan putusan yang ditetapkan bawahannya maka alasan tertulis disertakan bersama tanggapan tersebut.

PPID memberikan jawaban untuk memenuhi informasi atau tidak memenuhi, dalam 10 (sepuluh) hari kerja dan dapat diperpanjang selama 7 (tujuh) hari kerja.
